1. Acceptance of Terms

By creating an account or using the Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, our Cookie Policy, and our Acceptable Use Policy. If you do not agree, do not use the Service.

You must be at least 13 years old to use Faye Social. If you are between 13 and 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Description of Service

Faye Social is an AI-powered social media coach. It connects to your chosen third-party accounts (including Google Photos, Spotify, YouTube, Instagram, Facebook, and TikTok), analyzes your content and listening habits, and generates personalized post recommendations designed to help you share your life or grow your audience.

Faye operates primarily as a recommendation service, surfacing suggestions for what, when, and where to post. Creator tier subscribers may optionally enable auto-posting, which publishes scheduled content to connected platforms on your behalf. You maintain full control: auto-posting requires explicit opt-in per post, and you can cancel any scheduled post before it goes live.

3. Account Registration & Security

To use Faye you must create an account with a valid email address. You are responsible for:

• Keeping your password confidential.
• All activity that occurs under your account.
• Notifying us immediately at support@fayesocial.app if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised or are being used fraudulently.

4. User Content & Ownership

You own your content. When you connect a third-party account, the photos, videos, music, and posts you share with Faye remain yours. We do not claim any ownership over content you create or provide.

By using the Service you grant Faye a limited, non-exclusive, royalty-free license to access and process your content solely to deliver recommendations to you. This license ends when you disconnect the relevant account or delete your Faye account.

Photo data: Raw photos are processed entirely in memory to generate a quality score and are never written to disk or stored in our database. No copy of your original photos is retained by Faye Social.

5. AI-Generated Content Disclaimer

Faye uses Google Gemini for photo analysis and Anthropic Claude for caption generation. The captions, hashtags, and post recommendations produced by these models are suggestions only. They are not guarantees of engagement, reach, follower growth, or any other outcome.

AI-generated text may occasionally be inaccurate, incomplete, or unsuitable for your specific context. You are responsible for reviewing all suggestions before publishing them anywhere. Faye is not liable for any consequences arising from content you choose to post.

6. Data Handling & Privacy

Your privacy matters to us. Here are the headline commitments. The full details are in our Privacy Policy:

• OAuth tokens for connected accounts are encrypted at rest using AES-256 per-user keys.
• Raw photos are never stored. Processed in-memory only.
• No personally identifiable information is included in logs or error reports.
• California residents have CCPA rights (access, deletion, opt-out of sale). We do not sell your data.
• EU/UK users have equivalent GDPR rights. You can exercise them at support@fayesocial.app.
• You can export all your data or permanently delete your account at any time from your settings.

7. Connected Services

Faye integrates with third-party platforms including Google (Photos, YouTube), Meta (Instagram, Facebook), TikTok, and Spotify. Connecting these accounts is optional and granular. You choose which sources to enable, and the Service adapts accordingly.

Each connected platform has its own terms of service and privacy policy. You remain bound by those terms when using Faye Social. We are not responsible for the availability, accuracy, or conduct of any third-party platform. If a platform revokes or changes its API access, some Faye Social features may become unavailable without notice.

8. Subscription & Payment Terms

Faye offers the following paid tiers in addition to a free plan:

• Starter: $2/month: basic recommendations and insights
• Growth: $5/month: 90-day roadmap, analytics, competitor tracking
• Creator: $9/month: auto-posting, algorithm alerts, full feature set

Payments are processed by Stripe. By subscribing you authorize Stripe to charge your payment method on a recurring monthly basis until you cancel. All prices are in USD and exclusive of applicable taxes.

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will not be charged again, and you retain access to paid features until that date. We do not offer refunds for partial billing periods except where required by law.

We reserve the right to change pricing with at least 30 days’ notice sent to your registered email address.

9. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Post, generate, or distribute content that is hateful, harassing, threatening, or abusive.
• Infringe the intellectual property rights of any third party.
• Attempt to reverse-engineer, scrape, or extract data from the Service in ways not authorized by these Terms.
• Use the Service to train competing AI models without our written consent.
• Circumvent any security, rate-limiting, or access controls.
• Impersonate any person or entity.

Violation of these rules may result in immediate suspension or termination of your account.

10. Intellectual Property

The Faye name, logo, product design, and all software powering the Service are owned by Faye Inc. and protected by applicable copyright, trademark, and other intellectual property laws. These Terms do not grant you any right to use our branding or intellectual property outside of normal use of the Service.

11. Limitation of Liability

To the maximum extent permitted by law, Faye Inc. and its officers, directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunities, arising out of or related to your use of the Service.

Our total aggregate liability to you for any claim arising out of these Terms or the Service is limited to the greater of (a) the amount you paid to Faye in the 12 months preceding the claim, or (b) $100 USD.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Indemnification

You agree to defend, indemnify, and hold harmless Faye Inc. and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from (a) your use of the Service, (b) content you submit or post using recommendations from the Service, or (c) your violation of these Terms or any applicable law.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms or if we discontinue the Service, with reasonable notice where practicable.

On termination, your license to use the Service ends. Sections covering ownership, disclaimers, limitation of liability, indemnification, and governing law survive termination.

14. Changes to Terms

We may update these Terms from time to time. When we make material changes we will notify you by email or by displaying a prominent notice in the app at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

15. Governing Law & Disputes

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles.

Any dispute arising from these Terms or the Service will first be addressed through good-faith negotiation. If we cannot resolve the dispute informally within 30 days, both parties agree to resolve it through binding arbitration in San Francisco, California, under the rules of the American Arbitration Association (AAA), except that either party may bring a claim in small claims court for disputes within that court’s jurisdiction.

Class action waiver: You agree to resolve disputes with Faye on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.
